CHAUPE CASE: New process, new judge, new defense, same partial prosecutor

Yesterday, Tuesday 7th January at 9 am the final oral hearing took place of the current process in the trial brought by Yanacocha against the Chaupe family on charges of land usurpation.

A new judge was presented to the court on the principle of immediacy, thus the judge proposed the annulment of the current process in order to protect the right of the family to have the same judge presiding over the whole process.

The attorney for the Chaupe family, Dr Rosa Quedana, who replaces Dr Mirtha Vasquez who is currently on maternity leave, accepted the ruling. This new term would allow the possibility of the admittance of new evidence, and for the new defense to also be present for the entire process.

On the other hand the public prosecutor disagreed with the annulment – arguing that he was worried about the Chaupe family`s loss of time and money while traveling to Celendin for the extended process. This inconvenience didn`t seem to occur to him in the previous sessions as he read out irrelevant documents for hours, wasting time until finally the family was left without defense as the time arrived for Dr. Vasquez to give birth.  However, now that the family has new defense who is able to represent the family until the end of the process, the prosecutor now does not want to delay. This may be due to the mining company`s determination to begin their exploitation of the lagoons of Conga in 2014 – which is impeded by the family`s presence. This determination by the mining company and the state is also shown by the plan to complete the construction of a police base, accommodating hundreds of Special Unit National Police (DINOES), instructed to intervene in protests against the mining project.

The people of Celendin welcome the fairness of the new judge who is acting with respect to the law and the oath to uphold justice.

The new process will begin at 10 am on 10th March 2014, at the Penal Court of Celendin.

NOTA DE PRENSA: jUICIO A LA FAMILIA CHAUPE

El dia de hoy a las 9 am tuvo lugar la última audiencia oral en el caso del juicio que Yanacocha sigue a la familia Chaupe bajo el cargo de ursurpación de tierras.

Un nuevo juez se presentó a la audiencia declarando que por principio de inmediatez y para que los acusados puedan hacer uso correcto del derecho de defensa que la justicia les confiere, deberia de ser el mismo juez que siga todo el proceso de principio a fin. Es por eso que el nuevo juez declaró la anulación de todo lo actuado y el quiebre del proceso. Las partes fueron nuevamente citadas para el dia 10 de marzo a las 10 am para reiniciar el proceso.

La abogada de la familia Chaupe, la Dra Rosa Quedana que actúa en reemplazo de la Dra Mirtha Vasquez que como sabemos se encuentra en descanso de maternidad, aceptó el dictamen. Ese nuevo plazo permitiría la presentación de nuevas pruebas en favor de la familia Chaupe.

Por otro lado, curiosamente el fiscal, irritado por la medida, salió en defensa de la familia Chaupe alegando que les costaba tiempo y dinero para desplazarse a Celendin. Este hecho le importaba poco anteriormente. Lo que sucede es que el fiscal, que a todas luces actúa a favor de la mina, ve con preocupación el retraso en los trabajos en la laguna El Perol al no poder desalojar a la familia Chaupe. Además, en el mes de marzo se cumple el plazo de instalación del frente policial en la zona de Conga con la construcción de las nuevas comisarías y del helipuerto. Estas bases deben de albergar a cientos de DINOES dispuestos a intervenir en contra de los defensores del medioambiente.

El abogado de Yanacocha se expresó en contra de la decisión del juez.

Saludamos la imparcialidad del nuevo juez celendino que actúa respetando el derecho y el juramento de hacer respetar la justicia. Cabe resaltar que resoluciones del Tribunal Constitucional respaldan este derecho.
